Sa election liberals public housing tenants may lose the right to live next to their new tenants.

A bill to prevent tenants who rent in public housing apartments from facing eviction will now be passed, and will come into effect this month in Berkeley.

Public Housing Law's board, in a decision expected soon, approved a resolution to prohibit those public housing tenants from moving into public housing units with one of the three major housing codes. It applies to all public housing units except privately owned, affordable or market-rate housing. If this law passes, it would apply to everyone in Berkeley from the low-income apartment to the high-income apartment. It also excludes from the prohibition the "substantial use" and "significant activity" by those units h meaning they are not being occupied with single family residences, or apartments that serve a relatively small number of tenants.

Under Berkeley law, a resident in a housing code unit may be held in temporary custody on the basis of a short-term tenancy, even while an eviction application is pending.

"I was surprised by the bill and the public reaction," said Alex Kottarakis, campaign director for Occupy Berkeley, which supported the bill. "There was a lot of backlash, even from longtime residents."

The move by the UC Berkeley government comes after city, state and county lawmakers repeatedly attempted to extend and strengthen current housing codes to make sure the right tenants can live where they want.

The bill would allow the city and county to block eviction by making it impossible to block a short-term rent stay, said Mayor Tom Bates.

The mayor said he supported the measure from the beginning, but the council members who voted against it began considering an amendment last week that would have extended rent controls for another 30 days to be available to new tenants who rent at least 90 days per year.

Bates, a former City Council member who once owned and operated Berkeley Tenants Management, said the proposal was opposed by landlords who believe renters may not have the legal right to live in such housing units.

The change makes it far more difficult for tenants who want to buy or move to Berkeley to move into units that they own, which landlords are expected to rent to, because of rent control laws, said Mike McGovern, a real estate agent who works with residents in Berkeley's public housing.

"It creates obstacles, and it creates new problems for people trying to find a home," he said.

There are also concerns that the bill will result in more housing-allocation practices that may prevent people who need permanent housing from getting that housing, he said.

And they've warned that the situation will continue to grow from within. The council said that as new cultural director, they had no plans to reinstate the original cultural director who left earlier this month after 16 months. That would mean the future of a key museum site.

Auckland Council has also been given until 30 February to come up with a plan for the redevelopment of its old Exhibition grounds. It said it was seeking the input of community members to decide how to tackle Auckland Island's future.

Councillors' response Newcastle City Council's cultural director Andy Hall left a letter this week to members of the council, calling for them to "step up and be proactive in dealing with the future of your new cultural director".

Council said it had also no plans to reinstate former cultural director Andy Hall. They said "there is a need for immediate discussions and consideration of the cultural director's role, which is an integral part of how the Auckland cultural landscape is perceived around the city."

The Cultural Gallery on the western edge of the city centre is a key asset of the city, where the city holds a number of national and international exhibitions and events. The building, which has been in operation since 1970, is used by the Department of Conservation, which runs it.

It was formerly closed, before being refurbished when the city acquired the land, in 2004. Auckland Council said that was a process which would start with an assessment of the building and the museum, with an opportunity to work out what could be done, by way of building a new heritage building. They said they would be following through with the assessment as soon as they had had time to plan and implement the necessary work.
